Referral Agreements: Who Signs, Inbound vs. Outbound, How to Enter

Two referral articles exist in the KB. This one answers the specific questions that keep coming up: who actually signs, and how does it get entered.


Inbound Referrals (Client Sent to You)

Someone sends you a client. They expect a referral fee when that client closes.

Who signs:

  • The referring agent/broker signs
  • You (the receiving agent) sign
  • Bramlett does not sign the referral agreement on your behalf — you sign as the agent

Process:

  1. Get the signed referral agreement before you begin working with the client
  2. Attach the signed agreement to the transaction in the Super Portal when you enter it
  3. Enter the referral fee amount in the commission section — it is deducted from your gross commission before the Bramlett split is calculated

Outbound Referrals (You Send a Client to Another Agent)

You have a client outside your market or expertise and you're sending them to another agent in exchange for a referral fee.

Who signs:

  • You sign as the referring agent
  • The receiving agent/broker signs
  • Again, Bramlett does not co-sign — this is your agreement

Process:

  1. Execute the referral agreement before the client starts working with the other agent
  2. Enter the outbound referral as a separate transaction in the Super Portal
  3. Your referral fee is your commission on this transaction — enter it accordingly

Common Questions

Does Bramlett need to sign my referral agreement? No. As an independent contractor agent at Bramlett, you sign referral agreements in your own capacity. Bramlett is not a co-signatory on agent-to-agent referral agreements.

What if the referral agreement has Bramlett's brokerage name on it? Some forms include a "Brokerage" field. You may list Bramlett Partners as your brokerage, but the signing agent is you — not Bramlett staff.

Do I pay Bramlett a split on my outbound referral fee? Outbound referral fees received are treated as agent-generated income. Confirm the current split treatment with your ASM if unsure.

What if I forget to get a signed agreement before closing? Get it executed as soon as possible. A verbal agreement is not enforceable. Do not close without a signed referral agreement in place.
