Working with Unrepresented Buyers as a Listing Agent
With rare exceptions, we don't allow our agents to represent both parties or "double dip." You must obtain approval if you want to represent both parties. If a buyer is unrepresented, you want to ask them if they would like representation (in which case you'll refer them to an in-house agent) or if they want to self-represent. If they choose to self-represent, then you must do the following:
- Provide, explain, and have the IABS signed by the unrepresented buyer
- All parties to sign the GENERAL INFORMATION AND NOTICE TO BUYERS AND SELLERS and attach it to the contract package.
- All parties to sign the the TAR REPRESENTATION DISCLOSURE and attach it to the contract package.
- Add this verbiage to special provisions of the contract: "Listing broker will earn {X}% total and commission has been reduced from {X}% since buyer is not represented by an agent."
